Colin McKinney, Durham’s third cousin from Ripley, served on the Tennessee Supreme Court. In the Scopes case, he dissented the Dayton monkey trial from the court.
Judge McKinney used to take Durham to court in Nashville when he was a tiny child. In the Tennessee Supreme Court building, he took his first elevator ride. Because it was self-contained, he would hold Durham up to push the buttons.

In December of 2012, Durham married his long-time lover Cindy. After a six-year battle, Cindy, of Asian descent, was awarded American citizenship.
One of his two kids, Blair Durham (50 years old as of 2021), works as an attorney with his father. He also manages his father’s company. Blair is also a former Marine. Colin Durham, his other son, is a Samford University graduate married to Michele Durham (an attorney).
